Article 49

Costs and Expenses

1. As a general rule and except for protest cases, proceedings before the Disciplinary Committee are free of charge. Should there be costs associated with the proceedings, they shall be borne by the sanctioned party. In protest cases, the costs shall be borne by the defeated party.

2. The costs of proceedings before the Appeal Committee shall be borne by the sanctioned party. If no sanction is imposed, the costs shall be allocated considering the degree of success of the appeal.

3. Should a party generate unnecessary costs on account of its conduct, costs may be imposed upon it, irrespective of the outcome of the proceedings.

4. The relevant judicial body decides how costs and expenses shall be allocated. This decision is not subject to appeal.

5. Each party shall bear its own costs, including the costs of its own witnesses, representatives, legal advisers, interpreters and counsel, subject to article 46.
