Article 81

Appeal Committee

1. An appeal may be lodged by the party concerned, having a legally protected interest justifying amendment or cancellation of the decision, to the Appeal Committee against any decision taken by the adjudicatory chamber which relates to infringements of art. 29 of the present Code.


2. The aforementioned decisions may also be appealed by the chief of the investigation. Where the chief of the investigation appeals a decision, he is exempted from the appeal fee.


3. In any appeal, the chief of the investigation shall enjoy the same procedural rights as before the adjudicatory chamber.


4. Any motivated request for a hearing before the Appeal Committee must be made in or together with the reasons for appeal.


5. The appeal shall not have suspensive effect.
